Daddy Call Terms of Service

1. Eligibility and account registration

You must be at least 18 years old and able to form a binding contract to use Daddy Call. You agree to provide accurate account information, including a phone number you are authorized to use, and to keep your information reasonably current.

You are responsible for activity on your account and for safeguarding access to your device, magic links, sessions, and messages.

2. The service

Daddy Call is a consumer productivity service that helps users manage wake-up calls, go-to-bed calls, reminders, and related account interactions through the web, by phone, and by text. The service may use automated workflows, synthesized voice, AI assistance, and telephony providers to deliver its features.

Daddy Call is not an emergency service, medical device, therapist, crisis line, or safety-critical system. Do not rely on Daddy Call for emergencies, medical monitoring, life support, or any situation where failure, delay, or inaccuracy could create serious harm.

3. Consent to communications

Daddy Call's core scheduled call service can be used without opting into routine text messaging. Consent to receive automated text messages is not a condition of purchase or service. If you choose to opt in, Daddy Call may send service-related texts for requested account updates, setup help, schedule confirmations, reminders, and replies to messages you send us. Daddy Call may also place automated calls, including calls that may use artificial or synthesized voice, in connection with the service.

Message frequency varies based on your schedules, retries, account activity, and direct requests. Message and data rates may apply. Reply STOP to pause texts, START to turn them back on, or HELP for support information. Opting out of texts does not cancel active call schedules.

If you directly request a login link or other account-access message, we may send that requested message even if you previously paused routine texts, because the message is a direct response to your request.

4. Your responsibilities and acceptable use

You agree not to misuse the service, interfere with its operation, use it in violation of law, impersonate others, abuse support or telephony channels, reverse engineer restricted parts of the service, or use Daddy Call to harass, deceive, or harm anyone.

You are responsible for ensuring that your use of the service, including any phone number you provide and any calls or texts you initiate through Daddy Call, complies with applicable law, carrier rules, and the rights of others.

5. AI-assisted features

Daddy Call uses AI-assisted systems for tasks such as call handling, SMS assistance, summaries, and service improvement. AI systems may be inaccurate, incomplete, delayed, or inappropriate in ways we do not intend.

You should use judgment and not rely on AI outputs as professional, medical, legal, therapeutic, or emergency advice. We aim to use AI transparently and ethically, but we do not guarantee perfect outputs.

6. Fees and future paid features

Daddy Call may currently be offered free of charge or with limited introductory pricing. We may introduce paid features, subscriptions, or pricing changes in the future. If we do, we will provide notice and any additional billing terms that apply to those paid offerings.

7. Third-party services and carriers

Daddy Call depends on third-party providers for messaging, calling, AI, speech, analytics, hosting, and infrastructure. We are not responsible for carrier outages, delivery delays, handset settings, Do Not Disturb or Focus behavior, third-party downtime, or other events outside our reasonable control.

Wireless carriers are not liable for delayed or undelivered messages. Network quality, voicemail, device settings, and carrier behavior may affect whether calls or texts reach you as intended.

8. Intellectual property

Daddy Call, including its software, branding, design, content, and related materials, is owned by Domnik LLC or its licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to use the service for personal, lawful use.

9. Suspension and termination

We may suspend or terminate access to Daddy Call at any time if we believe you violated these Terms, created risk for users or the service, misused telephony or messaging channels, or if continued service is no longer practical or lawful. You may stop using the service at any time.

10. Disclaimer of warranties

Daddy Call is provided on an as is and as available basis. To the fullest extent permitted by law, Domnik LLC disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee uninterrupted availability, error-free operation, exact call timing, successful delivery, or perfect AI behavior.

11. Limitation of liability

To the fullest extent permitted by law, Domnik LLC and its officers, employees, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, business opportunity, or sleep-related outcomes arising out of or relating to the service.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to Daddy Call will not exceed the greater of fifty U.S. dollars (US$50) or the amount you paid us for the service in the three months before the event giving rise to the claim.

12. Indemnity

You agree to defend, indemnify, and hold harmless Domnik LLC and its officers, employees, contractors, and licensors from and against claims, liabilities, damages, losses, and expenses arising out of or related to your misuse of the service, your violation of these Terms, your violation of law, or your infringement of another person's rights.

13. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except that the Federal Arbitration Act governs the interpretation and enforcement of the arbitration provisions below.

14. Informal dispute resolution and arbitration

Before filing a claim, you and Domnik LLC agree to try to resolve the dispute informally. To start that process, email [email protected] with the subject line Legal Notice and a short description of the issue. If we cannot resolve the dispute within 60 days, either party may begin arbitration.

Except for claims that qualify for small claims court and claims seeking injunctive or equitable relief for misuse or intellectual property violations, any dispute, claim, or controversy arising out of or relating to these Terms or the service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will be conducted in English and may be held remotely, unless the arbitrator requires otherwise. Judgment on the award may be entered in any court of competent jurisdiction.

You and Domnik LLC each waive the right to a jury trial and to participate in a class action, class arbitration, consolidated action, private attorney general action, or representative proceeding. The arbitrator may award relief only on an individual basis.

You may opt out of this arbitration provision by emailing [email protected] within 30 days of first agreeing to these Terms. Your email must include your name, the phone number on your account, and a clear statement that you want to opt out of arbitration. If you opt out, disputes will be resolved exclusively in the state or federal courts located in Los Angeles County, California, and both parties consent to that venue and jurisdiction.

15. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will post the updated version here and update the effective date. By continuing to use Daddy Call after updated Terms become effective, you agree to the revised Terms to the extent permitted by law.
